Welcome to FulMeds (“Website”, “Mobile Application”, “we”, “our”, or “us”). These Terms and Conditions of Use (“Terms”) constitute a binding, legal contract between FulMeds and any individual or entity accessing, browsing, registering, or utilizing our medicine directories, article portals, search indices, and communication networks (collectively, the "Services").

BY CREATING AN ACCOUNT, COMPLETING THE REGISTRATION PROCESS, CHECKING THE APPLICABLE CONSENT BOX, OR CONTINUING TO ACCESS OUR SERVICES, YOU EXPLICITLY AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM ACCESSING THE SERVICES AND MUST IMMEDIATELY UNINSTALL OUR APPLICATION AND CEASE WEB BROWSING.

1. Eligibility and Account Registration

  • Age Mandate: You must be at least 18 years of age or the legal age of majority in your jurisdiction to register an account or utilize the Services independently.
  • Account Accuracy: You agree to provide true, accurate, and current information during onboarding. You are solely responsible for maintaining the confidentiality of your credentials (including third-party OAuth logins via Google, Apple, or Meta) and for all activities occurring under your account.
  • Account Termination: We reserve the absolute, unrestricted right to suspend, freeze, or permanently terminate your account or block your access to the Services at our sole discretion, without prior notice, liability, or giving a reason.

2. Strict Protection of Intellectual Property & Proprietary Database

The entire architecture of FulMeds—including but not limited to text, software, graphics, user interface layouts, look-and-feel, source code, logos, and our proprietary structured compilation, index, and database of approximately 400,000 medicine records, active ingredients, and clinical research data—is the exclusive intellectual property of FulMeds or its licensors.

  • No Extraction Rights: You are granted a limited, revocable, non-transferable, personal license to view the information for personal use only.
  • Asset Liquidation Protection: In the event that FulMeds undergoes a corporate restructuring, merger, acquisition, bankruptcy, or a wholesale sale of assets, all intellectual property rights, system code, and database compilations will transfer seamlessly to the acquiring entity as a core business asset.

3. Absolute Prohibition of Web Scraping, Data Mining, and AI Bots

Given the immense commercial value of the FulMeds medicine directory, we maintain a zero-tolerance policy against unauthorized data extraction.

  • Prohibited Automated Actions: You shall not deploy, program, or utilize any automated system, script, bot, spider, scraper, crawler, software offline reader, or artificial intelligence agent to access, harvest, mine, copy, index, or download our data or directory architecture.
  • Reverse-Engineering Ban: You are strictly prohibited from reverse-engineering, decompiling, or attempting to extract the underlying source code of our mobile application or website frameworks.
  • Legal Consequences: Any violation of this section constitutes a material breach of contract and an infringement of intellectual property rights. FulMeds will aggressively pursue criminal and civil actions, including seeking emergency injunctive relief and substantial monetary damages, against individuals or entities conducting unauthorized scraping.

4. No Medical Advice & Liability Disclaimer

  • Informational Content Only: FulMeds is a digital directory and informational platform. All data regarding medicines, active pharmaceutical ingredients, treatment guidelines, diseases, and clinical studies are provided strictly for educational and general informational purposes.
  • No Substitution: Content on this platform does NOT constitute medical advice, diagnosis, cross-examination, or a treatment recommendation. It cannot substitute for the professional judgment of a licensed physician or qualified pharmacist.
  • User Action: Always consult a medical professional before taking, changing, or discontinuing any medication or treatment plan. Never ignore or delay seeking professional clinical help due to something you read on FulMeds. Your reliance on any information found across our web or app channels is solely at your own risk.

5. Third-Party Brand Sponsors, Advertisements, and Outbound Links

  • Sponsored Material: FulMeds contains advertisements, sponsored content cards, and outbound hyper-links to third-party brand sponsors, health partners, and commercial online pharmacies.
  • Independent Transacting: We do not fulfill prescription orders directly, nor do we act as an agent for external entities. Any transactions, purchases, or data provided once you navigate away from our platform are strictly between you and that third party.
  • No Warranty or Endorsement: FulMeds does not investigate, verify, endorse, or accept liability for the claims, product safety, pricing, or compliance protocols of our advertisers or sponsors.

6. User-Generated Content License

If the Services allow you to post reviews, submit feedback, answer queries, or upload text:

  • License Grant: You grant FulMeds a perpetual, irrevocable, worldwide, royalty-free, fully sub-licensable license to host, modify, distribute, reproduce, display, and commercialize that content in any media format.
  • Prohibited Submissions: You agree not to post content that is defamatory, illegal, obscene, promotional of unauthorized third-party services, or containing malicious code. We retain the right to remove any submission instantly without notice.

7. Indemnification

You agree to indemnify, defend, and hold harmless FulMeds, its parent companies, owners, developers, directors, employees, and corporate affiliates from and against any and all claims, lawsuits, administrative penalties, liabilities, losses, damages, costs, and expenses (including legal fees) arising directly or indirectly out of:

  1. Your violation or breach of any clause within these Terms.
  2. Your misuse of our Services or medicine directory.
  3. Your infringement of any third-party intellectual property or privacy rights.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FULMEDS, ITS DEVELOPERS, AFFILIATES, OR OWNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF DATA, SYSTEM DOWN-TIME, OR ADVERSE HEALTH OUTCOMES/PERSONAL INJURY ARISING FROM TYPOGRAPHICAL ERRORS, OUTDATED DOSAGE ENTRIES, OR SYSTEM MISUSE RECORDED ACROSS OUR COMPONENT SYSTEMS.

9. Mandatory Dispute Resolution: Class-Action Waiver and Binding Arbitration

  • Binding Arbitration: Any dispute, controversy, or legal claim arising from or relating to your use of our website or mobile application, or the enforcement of these Terms, will be settled exclusively via individual, binding arbitration under the relevant local arbitration acts, bypassing courts of law entirely.
  • Class-Action Waiver: You explicitly waive any right to bring or participate in any class-action lawsuit, collective arbitration, or representative legal proceeding against FulMeds or its associated entities.

10. Governing Law & Jurisdiction

These Terms shall be governed by, interpreted, and construed in accordance with the laws of India, without regard to conflict of law principles. Subject to the binding arbitration clause, any legal actions that slip past arbitration must be filed exclusively in the courts located where the operating entity of FulMeds is officially incorporated.

11. Modifications to the Terms

We reserve the right to revise, update, or completely alter these Terms at any time without issuing individualized notices. All updates become operational immediately upon being posted to this page. Your continued use of the website or app following a terms update signifies your legally binding acceptance of the modified contract.
